1. Acceptance of Terms

Welcome to miXXlr, an interactive web-based party game ("Service") operated by miXXlr LLC ("Company," "we," "us," or "our"). By accessing or using the miXXlr website (the "Site") and Service, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you must not access or use the Service.

2. Age Restriction & Adult Content

2.1 Minimum Age. The Service contains uncensored user-generated content and themes intended for mature adults only. You must be at least eighteen (18) years of age to access and use the Service. In jurisdictions where the legal age for consuming adult content is higher (e.g., 21 years), you must meet that higher age requirement. By using the Service, you represent and warrant that you meet the applicable age requirement.

2.2 Content Warning. The Service may include, and users may generate, content that is sexually suggestive, profane, offensive, or otherwise intended for adult audiences ("Adult Content"). 3.1 Account Creation. You may be required to register an account. You agree to provide accurate information and keep it updated. You are solely responsible for all activity under your account.

3.2 Prohibited Conduct. You agree NOT to use the Service to:

• Post content that is unlawful, defamatory, libelous, obscene, or invasive of privacy.
• Impersonate any person or entity.
• Use cheats, exploits, or automated bots to interfere with the Service.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Violate any applicable local, state, national, or international law.

3.3 Content Moderation. We reserve the right, but not the obligation, to monitor, review, and remove any user-generated content at our sole discretion, without notice or liability.

4. Intellectual Property Rights

4.1 Our Rights. The Service, including its software, design, text, graphics, logos, and all content we provide (excluding User Content), is owned by miXXlr LLC and is protected by copyright, trademark, and other intellectual property laws.

4.2 License to You. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment, subject to these Terms.

4.3 User Content License. By submitting, posting, or displaying any content on the Service ("User Content"), you grant miXXlr LLC a worldwide, perpetual, royalty-free, sublicensable license to use, host, store, reproduce, modify, and display such content for the purpose of operating, promoting, and improving the Service.

5. Disclaimers and Limitation of Liability

5.1 Service "As Is." THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

5.2 No Liability for User Content. WE ARE NOT RESPONSIBLE FOR ANY USER CONTENT. YOUR INTERACTIONS WITH OTHER USERS ARE SOLELY BETWEEN YOU AND SUCH USERS. YOU BEAR ALL RISK ASSOCIATED WITH SUCH INTERACTIONS AND CONTENT.

5.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, miXXlr LLC, ITS OWNER, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.

6. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.

7. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Minnesota, USA, without regard to its conflict of law principles. Any dispute shall be resolved through final and binding arbitration in Hennepin County, Minnesota, on an individual basis, not as a class action.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance.
